b) Use of the Website is offered to the User conditioned on acceptance without modification of all the terms, conditions and notices contained in these Terms, as may be posted on the Website from time to time. www.apparelindia.com at its sole discretion reserves the right not to accept a User from registering on the Website without assigning any reason thereof.

Service Definition

www.apparelindia.com provides visitors with access to sale of apparel and related products online ("Service"). Users may be notified about products on offer through their registered Email id and Phone number on a regular basis. Users may provide their feedback and reviews about the products which may be shared by www.apparelindia.com with the other users or any third party.

License and Site Access

www.apparelindia.com grants users a limited license to access and make personal use of the Website and the Service. The User agrees and undertakes not to reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or software obtained from the Website. Pricing Information

While www.apparelindia.com strives to provide accurate and the latest information on its Website, Prices and availability are subject to change without notice.In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, we may, at our discretion, either contact the user for instructions or cancel user’s order and notify of such cancellation. We will have the right to modify the price of the product and contact the user for further instructions using the e-mail address provided by the user during the time of registration, or cancel the order and notify of such cancellation. In the event that www.apparelindia.com accepts user’s order the same shall be debited to user’s credit card account. The payment may be processed prior to dispatch of the product ordered. If we have to cancel the order after we have processed the payment, the said amount will be reversed back to the credit card account.

Cancellation

There may be orders that we are unable to accept and cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by with the user’s payment method. We may also require additional verifications or information before accepting any order. We will contact the user if all or any portion of the order is canceled or if additional information is required to accept the order. If the order is cancelled after user’s credit card has been charged, the said amount will be reversed to the Card Account.In case of requests for order cancellations, www.apparelindia.com reserves the right to accept or reject requests for order cancellations for any reason. As part of usual business practice, if we receive a cancellation notice and the order has not been processed / approved by us, we shall cancel the order and refund the entire amount. We will not be able to cancel orders that have already been processed. We have the full right to decide whether an order has been processed or not. The customer agrees not to dispute the decision made by www.apparelindia.com and accept www.apparelindia.com's decision regarding the cancellation.

Fraudulent /Declined Transactions

We constantly monitor the user’s account in order to avoid fraudulent accounts and transactions. Users with more than one account or availing multiple promotions meant for single use shall be liable for legal actions under law and we reserve the right to recover the cost of goods, collection charges and lawyers fees from persons using the Website fraudulently. www.apparelindia.com reserves the right to initiate legal proceedings against such persons for fraudulent use of the Website and any other unlawful acts or omissions in breach of these terms and conditions. In the event of detection of any fraudulent or declined transaction, prior to initiation of legal actions, www.apparelindia.com reserves the right to immediately delete such account and dishonor all past and pending orders without any liability. For the purpose of this clause, www.apparelindia.com shall owe no liability for any refunds.

Payment Details

The User agrees, understands and confirms that the payment details including debit / credit card, netbanking details provided by him/her for availing of services on www.apparelindia.com will be correct and accurate and he/she shall not use the payment method which is not lawfully owned by the user. Users further agree and undertake to provide the correct and valid payment details to www.apparelindia.com. Further the said information will not be utilized and shared by www.apparelindia.com with any of the third parties unless required for fraud verifications or by law, regulation or court order. www.apparelindia.com will not be liable for any payment related fraud. The liability for use of payment details fraudulently will be on the user and the onus to 'prove otherwise' shall be exclusively with the user.

Limitation of Liability

www.apparelindia.com will not be liable for short delivery or defective Goods unless a claim is notified by the user in writing within 14 days of delivery in accordance with Return and Exchange Terms. The notification must include the order number, invoice number and details of the claim. www.apparelindia.com will not be liable in any way for loss, damage, costs or expenses (including loss of profit) arising directly or indirectly from any failure or delay in performing any obligation under this Contract by reason of any event or circumstance outside the reasonable control of www.apparelindia.com, including but not limited to, any strike, industrial action, failure of power supplies or equipment, government action or Act of God.You expressly understand and agree that www.apparelindia.com and its subsidiaries, affiliates, officers, employees, agents, partners and licensors shall not be liable to the user for any direct, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if www.apparelindia.com has been advised of the possibility of such damages), resulting from use of the Website, sale and supply of goods content or any related services.This limitation of liability section shall prevail over any conflicting or inconsistent provision contained in any of the documents comprising this Agreement. Indemnity

Trademarks

The trademarks, logos and service marks ("Marks") displayed on the Site are the property of www.apparelindia.com and other respective persons. Users are prohibited from using any Marks for any purpose including, but not limited to use as meta tags on other pages or sites on the World Wide Web without the written permission of www.apparelindia.com or such third party which may own the Marks.

Billing

The price of our merchandise is inclusive of the VAT. The VAT charged shall depend upon the destination where the order has to be shipped. The tax rate applied to the order will be the combined tax rate for both state and local tax rates in accordance with the address where the order is being shipped. www.apparelindia.com reserves the right to collect taxes for shipping charges wherever applicable.

Credit and Vouchers

User can redeem only one voucher during a single purchase. www.apparelindia.com reserves the right to terminate the said promotional scheme without any prior notice to its users. 

Registration Vouchers: www.apparelindia.com issues registration vouchers to users who register on the site. Users are eligible to be issued and for subsequent redemption of this voucher only once. www.apparelindia.com reserves the right to decline a voucher if it decides that the user is using the registration voucher more than once.

Referral Vouchers (Also called Refer a friend discount): www.apparelindia.com provides free shopping vouchers to the referrer; the said voucher is emailed 15 days after successful delivery of the first order of the person referred. Users can view their referral voucher the My Account section on the website and redeem them in the Cart section before the checkout. Referral voucher shall not be issued to a user in case the referred person has the same delivery address and/or contact number as that of the referring person. www.apparelindia.com reserves the right to make changes/amend the policy(s) regarding the referral voucher. The user agrees to allow www.apparelindia.com to verify the validity of the referrals who register with www.apparelindia.com through email/phone call.

Other Promotional Vouchers: There are other types of limited period vouchers which can be issued, or cancelled by www.apparelindia.com as part of any campaign or scheme. The terms for these campaigns will be decided by www.apparelindia.com at the time of the campaign and these should be acceptable to the user. Store Credit Vouchers: In case of returns/exchange, www.apparelindia.com shall provide store credit vouchers to the users if the requested exchange could not be performed. The user shall be provided with a store credit upon the completion of the return/exchange process and the same shall have a validity of 6 (six) months from the date of issue of the store credit voucher. The above mentioned voucher/credit cannot be used in parts and has to be used as a whole only. Only one voucher/credit is allowed per transaction

Delivery

www.apparelindia.com endeavours but does not guarantee to deliver the products to customers within 2-3 weeks from the day of close of sale depending upon the shipping location. www.apparelindia.com works with different type of suppliers (Manufacturers, distributors, importers etc.) and the delivery time to customers is subject to delivery of products from supplier to www.apparelindia.com. Other factors include delay in delivery through the courier partner, transporters’ strike etc. www.apparelindia.com will not be liable for any loss or expenses sustained by the user arising from any delay in the delivery of the goods howsoever caused.www.apparelindia.com reserves the right to make delivery of the goods by installments. If the goods are to be delivered in installments, each delivery will constitute a separate contract. User may not treat the contract (as a whole) as repudiated if www.apparelindia.com fails to deliver any one or more of the installments or if the user has a claim in respect of any one or more of the installments.If the user fails to take delivery of the goods, www.apparelindia.com may at its discretion charge the user for the additional shipping cost. Title and risk of loss for all products ordered by the user shall pass on to the user upon www.apparelindia.com's shipment to the shipping carrier.

Returns and Exchange

www.apparelindia.com may accept returns if the product does not meet the specifications indicated on the website. For this purpose www.apparelindia.com must receive the merchandise within 14 days from the date it was shipped to the user. Items must be unused, unworn, unwashed and undamaged. Goods will be returned only if they are returned in their original packaging, including: hangers, poly bags, hang tags, gift boxes etc. Items bought on discount or other promotional schemes may not be returned / exchanged.We do not provide cash refund on any goods sold. Goods once sold can only be exchanged for replacement or a store credit. Store credit means credit issued to your account for the entire purchase amount less the shipping costs. Your account credit can be used towards your next purchase with www.apparelindia.com. To return an item, the customer must write to us at customercare@apparelindia.com. Alternatively, the customer may even call at our customer care number +91-9958-991405 which remains open Monday to Friday 10 am to 6 pm. All return/exchange shall be authorized at the sole discretion of www.apparelindia.com.

The headings and subheadings herein are included for convenience and identification only and are not intended to describe, interpret, define or limit the scope, extent or intent of the Terms or the right to use the Website by you contained herein or any other section or pages of the Website or any Linked Sites in any manner whatsoever.

Interpretation of number and genders

The Terms herein shall apply equally to both the singular and plural form of the terms defined. Whenever the context may require, any pronoun shall include the corresponding masculine and feminine. The words "include", "includes" and "including" shall be deemed to be followed by the phrase "without limitation". Unless the context otherwise requires, the terms "herein", "hereof", "hereto", "hereunder" and words of similar import refer to the Terms as a whole.

Report Abuse

As per these Terms, users are solely responsible for every material or content uploaded on to the Website. www.apparelindia.com does not review the contents in any way before they appear on the Website. www.apparelindia.com does not verify, endorse or otherwise vouch for the contents of any user or any content generally posted or uploaded on to the Website. Users can be held legally liable for their contents and may be held legally accountable if their contents or material include, for example, defamatory comments or material protected by copyright, trademark, etc. If you come across any abuse or violation of these Terms, please report to compliance@apparelindia.com.

Survival of Terms after Agreement Ends

Notwithstanding any other provisions of these Terms, or any general legal principles to the contrary, any of the provisions of these Terms that imposes or contemplates continuing obligations on a party will survive the expiration or termination of these Terms.

General

If any of these conditions are deemed invalid, void, or for any reason unenforceable, the parties agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the unenforceable condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition. To avail of such promotional offers, user agree to be bound by any additional terms and conditions for these special offers which are laid down by www.apparelindia.com. These Terms and the relationship between the user and www.apparelindia.com will be governed by the laws as applicable in India. Any disputes will be handled in the competent courts of New Delhi, India. The failure of www.apparelindia.com to act with respect to a breach by the user or others does not waive its right to act with respect to subsequent or similar breaches. www.apparelindia.com does not guarantee it will take action against all breaches of these Terms. Except as otherwise, expressly provided in these Terms, there shall be no third-party beneficiaries to these Terms. These Terms constitute the entire agreement between the user and www.apparelindia.com and governs user’s use of the Website, superseding any prior agreements between the User and www.apparelindia.com with respect to the Website and Services.
